自己紹介 / Biography

私は、国際法・国際環境法を専門としています。またその他、国家実行の研究もしています。写真は、科研（https://kaken.nii.ac.jp/ja/grant/KAKENHI-PROJECT-25K00581/）の研究をもとに、昨年12月東北大学国際法政策センターに共催していただき、国際法における将来世代法（域）（International Law for the Futureとでもいうべきもの）の醸成可能性を模索する国際会議を開催した時のものです。将来世代についての出版をしたばかりのProf. Peter Lawrenceの考察から開始し、その後、諸国や地域の国家実行、考え方を見ました（韓国・台湾・フィリピン・ベトナム・インドネシア、日本、オーストラリア、米州、EU）。日本については大阪大学・大久保先生、京都大学・一原先生にEUについては一橋大学・中西先生にお話を伺いました。そして、その後、それらを踏まえて、本年7月のICJ気候変動意見の分析（Prof. Bossion de Chazournes）を行いました。こちらは神戸大学・阿部先生にコメントをいただきました。最終日12月14日の東京外国語大学でのセッションでは、Prof. Edith Brown Weissが行ってきた先駆的研究をベースに、将来世代の権利・利益に関する哲学的考察をProf. Andre Nollkaempeが、また人権からのアプローチを超えた環境保護へのアプローチにつき、Prof.Malgosia Fitzmaurice（自然の権利）とProf.Virginie Barral（文化的権利、世代間衡平）が行いました。
　本科研の研究では、今日、環境法、とくに気候変動との関係で強く意識されている「将来世代の権利・利益」ですが、実は、「将来世代への配慮」というものは、これまでも国際法の他の領域に他の概念や法制度の形をとって、埋め込まれてきており、あるいは現に生じつつあると考えております。したがって、その点について、様々な領域における検証も行います。海洋法（東京大学・西本先生）、経済法（静岡県立大学・石川先生）、武力紛争法（中京大学・保井先生）、刑事法（立命館大学・越智先生）、宇宙法（東京大学・高屋先生）です。コメンテーターとして、一橋大学・竹村先生、小樽商科大学・小林先生もご貢献くださいました。素晴らしい会議となりました。会議の様子については、Prof.Malgosia Fitzmauriceが書いてくださっているので、ぜひそちらもご参照ください（https://www.linkedin.com/posts/malgosia-fitzmaurice-902b0510_i-just-got-back-from-tokyo-where-professor-activity-7406783621270982658-ot9j）。
